In using this website you are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you and accepting the Company’s terms and conditions. "The Company", “Ourselves”, “We” and "Us", refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Privacy Statement

We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

Confidentiality

We are covered under the Data Protection Act 1998 and as such, any information concerning the Client and their respective Client Records may be passed to third parties. However, Client records are regarded as confidential and therefore will not be divulged to any third party, other than [our manufacturer/supplier(s) and] if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties. We will not sell, share, or rent your personal information to any third party. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Warranty (UK Mainland)

• Covers hardware failure but excludes accidental damage or user error.

• 14 day returns policy.

• Free lifetime telephone support.

• Any suspected hardware failure should be reported to GLOBAL VISUAL first. GLOBAL VISUAL will then provide telephone technical support to determine hardware failure; hardware failure must be confirmed by GLOBAL VISUAL.

Standard 3 year warranty (for all listed products purchased after 18/01/2016):

• All screen sizes up to and including 55” are covered by a swap-out or collect and return service. Once hardware failure has been determined by GLOBAL VISUAL over the phone the screen should be repackaged using the original packaging. At this point GLOBAL VISUAL, at their discretion, will either:

• Arrange for collection of the faulty screen by a courier service, then once the screen is back with GLOBAL VISUAL it will either be repaired or replaced with a new unit, or

• A replacement screen will be sent out and a courier service will be used to collect the faulty screen.

• All deliveries and collections will be at the cost of GLOBAL VISUAL.

• If the screen is not packaged correctly no liability will be taken by GLOBAL VISUAL if the product is damaged during transit.

• If the screen is returned in full working order no liability will be taken by GLOBAL VISUAL and any costs incurred will be passed on to the customer.

• UK Mainland only: Screens sizes above and exclusive of 55” and freestanding (L-series) products are covered by an on-site service. Once hardware failure has been determined by GLOBAL VISUAL over the phone GLOBAL VISUAL will arrange for technician(s) to make an on-site visit to repair or replace the faulty screen.

• The screen(s) must be in a location accessible to our technician(s) and in no circumstances would GLOBAL VISUAL staff be expected to remove screens or disassemble non standard installations or constructions or be expected to work above ground level.

• Where no genuine hardware failure has occurred a call out charge of at least £150 (+VAT) is payable for each visit.

• For customised or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.

Old 1 year warranty (for all listed products purchased before 18/01/2016):

• The screen(s) must be in a location accessible to our technician(s) and in no circumstances would GLOBAL VISUAL staff be expected to remove screens or disassemble non standard installations or constructions or be expected to work above ground level.

• Where no genuine hardware failure has occurred a call out charge of at least £150 (+VAT) is payable for each visit.

• For customised or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.

This warranty covers hardware failure and shall not apply to the following, including, but not limited to: damage which occurs in shipment; delivery and installation; applications and uses for which this product was not intended; altered product or serial numbers; cosmetic damage or exterior finish; accidents, abuse, neglect, fire, water, lightning or other aspects of nature; use of products, equipment, systems, utilities, services, parts, supplies, accessories, applications, installations, repairs, external wiring or connectors not supplied or authorized by GLOBAL VISUAL, or which damage this product or result in service problems; incorrect electrical voltage, fluctuations and surges; customer adjustments and failure to follow operating instructions, cleaning, maintenance and environmental instructions; product removal or reinstallation; reception or display problems and distortion related to noise, echo, interference or other signal transmission and delivery problems; reduced screen brightness related to normal aging, or burned-in images.

Warranty (overseas)

• Covers hardware failure but excludes accidental damage or user error.

• Free lifetime telephone support.

• Any suspected hardware failure should be reported to GLOBAL VISUAL first. GLOBAL VISUAL will then provide telephone technical support to determine hardware failure; hardware failure must be confirmed by GLOBAL VISUAL.

• Once hardware failure has been determined by GLOBAL VISUAL over the phone replacement parts, along with an instructional guide, will be sent to the Client at the cost of GLOBAL VISUAL. If the Client does not have the facility to repair the product then the screen should be repackaged using the original packaging and returned to our factory in China (or another specified location) at their cost. The product will then be repaired and sent back to the Client at the cost of GLOBAL VISUAL.

• In the event of advanced replacement parts being sent to the Client GLOBAL VISUAL reserves the right to request faulty parts be returned to us at the cost of the Client after the repair work has been carried out. GLOBAL VISUAL also reserves the right to request that faulty parts be returned to us for repair at the cost of the Client in the event that advanced replacement parts are unable to be sent.

• If the screen is not packaged correctly no liability will be taken by GLOBAL VISUAL if the product is damaged during transit.

• If the screen is returned in full working order no liability will be taken by GLOBAL VISUAL and any costs incurred will be passed on to the customer.

• For customised or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.

Old 1 year warranty (for all listed products purchased before 18/01/2016):

• Once hardware failure has been determined by GLOBAL VISUAL over the phone replacement parts, along with an instructional guide, will be sent to the Client at the cost of GLOBAL VISUAL. If the Client does not have the facility to repair the product then the screen should be repackaged using the original packaging and returned to our factory in China (or another specified location) at their cost. The product will then be repaired and sent back to the Client at the cost of GLOBAL VISUAL.
• In the event of advanced replacement parts being sent to the Client GLOBAL VISUAL reserves the right to request faulty parts be returned to us at the cost of the Client after the repair work has been carried out. GLOBAL VISUAL also reserves the right to request that faulty parts be returned to us for repair at the cost of the Client in the event that advanced replacement parts are unable to be sent.

• If the screen is not packaged correctly no liability will be taken by GLOBAL VISUAL if the product is damaged during transit.

• If the screen is returned in full working order no liability will be taken by GLOBAL VISUAL and any costs incurred will be passed on to the customer.

• For customised or out of stock items the turnaround period is dependent upon factors such as, but not limited to, availability, production and shipping.

Disclaimer

Delivery

GLOBAL VISUAL uses the third party courier to arrange and carry out deliveries and collections. GLOBAL VISUAL does not accept the responsibility, and will not offer any compensation, for any loss of profits caused due to the late delivery of any items by the courier. This is includes, but is not exclusive of, a project being delayed, missed organised installation time or date or any other inconvenience caused to the customer. GLOBAL VISUAL will share any relevant contact information including, but not limited to, name, phone number, email address, geographical address and facsimile number with the third party courier we use for delivery of goods. Exclusions and Limitations

The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

• excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and

• excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

• If you are returning your purchase the product must be complete and in ‘as new’ condition. If you have opened the box to examine the product you must have done so without damaging or marking the product or packaging. It should be returned with the original box and packaging, along with any accessories you received with it. If you follow the above, we will issue you with a full refund for the cost of the product.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected. Payment

Cash, Cheque or BACS Transfer are all acceptable methods of payment. Our Terms for

• Special, approved or customised order: 30% deposit to be paid when order placed and full payment upon delivery.

• An optional leasing agreement may be available depending upon the quantity and value of the order. We will not provide the leasing facilities in-house but will contact a leasing company if this is necessary.

All goods remain the property of the Company until paid for in full. Monies that remains outstanding by the due date will incur late payment interest at the rate of 2% above the prevailing Bank of England's base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. Where stock is returned, for any reason, GLOBAL VISUAL reserve the right to charge a restocking fee. There is a return policy on standard products with full refund excluding delivery charges (UK only). Customised, special or approved orders are not covered by the return policy and only monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.

Specific points are outlined below:

(a) Damage, shortages and discrepancies: The Buyer shall be responsible for inspecting the Goods on delivery to check the Goods for damages, shortages and discrepancies. If there is any damage, shortage or discrepancy with respect of the Goods, the Buyer shall notify GLOBAL VISUAL in writing within 3 Working Days of delivery. If the Buyer fails to do so then GLOBAL VISUAL shall not be liable for the damage, shortage or discrepancy. A "delivery" or "arrivals" note signed by the Buyer or its agent indicating that the Goods are in good order on arrival shall be conclusive proof of the same and bind the Buyer.

(b) Goods that fail on installation: GLOBAL VISUAL operates a returns procedure for Goods that fail on installation. The Buyer must comply with all instructions given to it by GLOBAL VISUAL in relation to the applicable Goods that fail on installation returns procedure. The Buyer shall notify GLOBAL VISUAL in writing, within 24 hours, if any Goods appear to have failed. The Buyer must notify GLOBAL VISUAL of any apparent Goods that fail on installation within 5 Working Days of delivery. (c) Goods that fail after installation: Faulty Goods must not be returned to GLOBAL VISUAL without notice. The Buyer must notify GLOBAL VISUAL within 3 Working Days of the fault becoming apparent and follow the instructions notified to it by GLOBAL VISUAL in relation to the fault.

(d) General provisions relating to Goods that fail on installation and Faulty Goods: (1) Should the Buyer return the Goods otherwise than as set out in these Terms and Conditions then the Buyer shall pay all GLOBAL VISUAL' costs and expenses in liaising with the manufacturer concerning the return. (2) The Buyer shall pay all GLOBAL VISUAL' costs and expenses if the Goods suspected to be Goods that fail on installation or Faulty Goods prove not to be Goods that fail on installation or Faulty Goods. (3) The Buyer shall be responsible for all transportation and insurance costs relating to returned Goods. (4) GLOBAL VISUAL shall not be responsible for installation of returned Goods after repair or exchange. (5) Any labour costs and expenses incurred in extracting defective parts and/or components shall be borne by the Buyer and if incurred by GLOBAL VISUAL shall be paid for by the Buyer at GLOBAL VISUAL' then standard applicable rate. (6) The Buyer shall also be responsible for all GLOBAL VISUAL' costs if GLOBAL VISUAL agrees to collect the Goods for return and such Goods are not ready for collection at the agreed time.

Availability

You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused. General Data Protection Regulation

No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

The laws of England and Wales govern these terms and conditions. By accessing this website and using our services/buying our products you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of such access. These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a purchase or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.



PRICE MATCH TERMS

• The product in question must be new, identical in style, specification, size and colour, and offered on the same terms.
• Our Price Promise can be claimed against any competitor in the mainland UK, including UK websites but excluding factory outlets, membership clubs, duty free shops, home shopping channels, auction sites, market stalls, private sales and liquidation (or any other "closing down" or insolvency) sales.
• The competitor store or website must have the product in stock and available for immediate purchase or delivery. • We must also have the product in question in stock.
• Gift vouchers are exempt.
• Typographical errors shall not apply. No affiliate, promotional, voucher code or media discount applies. Any other retailer's price match promotion which offers an additional rebate or other benefit for any price matched product is also excluded.
• We must be able to verify the lower price being offered by the competitor to our satisfaction.
• The price being matched must include all taxes (including VAT), postage and packing charges as applicable.
• Our Price Promise applies up to 7 days after purchase. Proof of purchase will be required, without exception.
• All Price Promise transactions are carried out at the discretion of Global Visual.
• We reserve the right to withdraw this Price Promise at any time.

PRINT TERMS AND CONDITIONS

These Terms and Conditions apply to all orders and supersede all others. Receipt of acknowledgement of order by you, constitutes your acceptance that our conditions are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.

PAYMENT TERMS

PAYMENT

Full payment is required on order. VAT

Some printed items become subject to VAT, dependent on the contents of the artwork. If you place an order and such a payment applies, VAT will be added to your order Global Visual Limited. Registered in England and Wales No. 11085956. VAT No. 291 0433 23

OVERDUE ACCOUNTS

No goods will be delivered on accounts which remain unpaid 14 days after payment is due. We reserve the right to charge interest on overdue accounts, at the rate of 5% above the Barclays Bank Plc base rate from time to time from the date the account became due until payment is received.
This does not prevent us from pursuing payment of overdue accounts at any time after payment becomes due and shall be in addition to and without prejudice to any other rights we may have against you.

We reserve the right to charge you for any legal or collection charges where it is necessary to obtain payment from you of an overdue account through a third party or Court proceedings.

PASSING OF TITLE AND RISK

The risk in the goods shall pass to you on delivery.

All goods, delivered or not, remain our property until payment is received in full.

Until such time as payment is made you shall retain such goods separately from other goods and clearly mark them in such a way that they can be readily identified as being our property and any payment received by you for any sale of such goods must be held in a separate account in trust for us. In the event of non-payment for such goods we will, without loss of any rights or remedy, remove from your possession those goods belonging to us in accordance with these conditions and we shall be entitled to enter upon the property where the goods are stored to repossess and remove the same. You hereby grant us an irrevocable licence to enter your premises for the said purposes.

PRODUCTS

We reserve the right to alter any details of products advertised without notice and while every effort is made to describe goods accurately in the advertisement, no warranty is given as to accuracy and no responsibility will be accepted for error and any resulting loss*

QUOTATIONS AND CONTRACTS

Orders are accepted subject to our right to adjust prices quoted to take account of any changes in the law or Government regulations requiring us to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise. The prices are based on today¹s current costs of production and in the event of any increase in wages or costs of materials to us occurring after the confirmation of accepted contract, we shall be entitled to charge such increases to you.

Quotations are only valid for 30 days after the initial quote date.

Any price or quotations is subject to change at any point without notice, including advertised offers.

PRICES

Where applicable all prices quoted are subject to VAT at the current rate.

DELIVERY

Every effort will be made to deliver on time, but any delivery day specified is a best estimate and no liability is accepted for any loss arising from delay or error in the delivery of the goods.

Global Visual Ltd. accepts no responsibility for deliveries being missed due to non payment. It is the customers responsibility to ensure that full payment is made before delivery can take place.

International transit times are approximate and may be subject to customs clearance. Local country restrictions apply. Global Visual Ltd. will not be held responsible for any delay of delivery of the goods with international deliveries.

Global Visual Ltd. cannot be held responsible for any customs and excise charges that may occur from the import or export of your goods. QUANTITY VARIATION

We shall be deemed to have fulfilled our contract by delivery of a quantity within 5% plus or minus of the quantity of printed goods ordered and you will be charged at the contract rate for the quantity delivered.

CLAIMS

Claims arising from damages, delay or partial loss in transit must be made in writing to us, so as to reach us within 5 days of delivery.

All claims with regard to the quality or quantity of the goods shall be made in writing to us so as to reach us within 5 working days of receipt of goods or such goods shall be deemed to comply as to quality and quantity within the terms of the contract.

You must examine all goods delivered at the time of delivery. We shall not be liable for any loss arising from damage caused to the goods in transit unless loss or damage is noted on the delivery note at time of delivery.

Claims in respect of non-delivery must be made in writing so as to reach us within 4 days from receipt of our invoice.

Global Visual Ltd. requires any printing to be returned in full before agreeing to reprint. If Global Visual Ltd. deem the printing to be of sufficient quality, and within tolerance we reserve the right to return the goods and refuse a reprint or refund.

LIABILITY

Save in so far as defects in the goods cause death injury or damage to personal property, our liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods.

We can accept no responsibility for loss or damage arising from the supply of goods under this contract unless you have fully complied with the notification of claims procedure set out in clause 10.

We are not liable for any financial loss incurred by you, including but not limited to expenses incurred by you, interest payments & loss of earnings or similar gains you would have received on monies paid to us in lieu of any unfulfilled order.

Nothing in these terms and conditions shall affect the rights of a consumer.

REFUNDS

We Reserve the right to rectify defective work by reprinting and shall not be liable to refund.

Global Visual Ltd. will credit your account if we deem a refund should be made.

If we offer to replace you must accept such an offer unless you can show clear cause for refusing to do so.

If you do opt to have work re-done by a third party without reference to us you automatically revoke your right to any remedy from us.

All defective work must be returned to us before replacement, if the subject work is not available we will assume that it has been accepted and no replacement will be provided.

Refunds will take 3 to 4 working days to complete once Global Visual Ltd. has agreed to refund. This cannot be completed any faster.

CANCELLATION CHARGES Any costs incurred for work already carried out up to the date of written cancellation will also be charged for and deducted before any refunds are made. If the order has not yet been paid for then an invoice will be raised for the amount concerned and sent to the responsible party.

QUANTITY CHANGES TO ORDERS

Any changes in quantity ordered must be made in writing to us prior to commencement of processing. Any increases in the order must be regarded as a separate contract unless written notification is received before work commences on the original order.

ARTWORK AND PRINTING

All artwork is printed using CMYK unless otherwise requested by the customer. Such a request will incur an additional fee.

All orders are completed solely on the basis of the Artwork and information provided to Global Visual Ltd. by the customer. Any additional costs that arise due to the inaccuracy of the artwork supplied will be the sole responsibility of the customer.

Once your design project is initiated and any preliminary artwork has been created by Global Visual Ltd., all retainer payments made by you become non-refundable. Once you have placed your order, you will not be able to make changes to the artwork you have supplied, you will become liable to charges if you need to amend or supply new artwork.

For all orders (including online), we only quote for one design per kind, any additional are chargeable.

We will print the order before payment has been made, unless otherwise specified by Global Visual Ltd.

PROOFS

Please note that the colour of the printed item will be affected by the type of material chosen for the artwork to be printed on, as well as any applied Lamination or Varnish. Global Visual Ltd. will not accept liability or responsibility for any variations in colour or any other defects or irregularities as a result of this.

Proofs are NOT supplied as standard. Proofs must be requested by the person ordering at the time of ordering in writing, verbal confirmation will not be accepted. All proofs are subject to an additional charge unless otherwise agreed.

If whilst performing a standard or advanced (proofing) check, Global Visual Ltd. discovers that the Artwork provided by the customer is defective or incorrect, Global Visual Ltd. will notify the customer. It is the customers responsibility to either provide the corrected artwork, or give permission for Global Visual Ltd. to make the necessary changes (charges will be applicable). If the customer chooses to proceed without making the advised corrections, then they do so at their own risk. We will not be help responsible for any mistakes, viewing, spelling, punctuation, contact details or layout.

Please check proofs thoroughly as once passed, all proofs are deemed correct and ready to go print and the responsibility passes to the customer. You will need to view all proofs at 100% to see the exact size of your product when printed. We will not commence print until we have received a copy of the final proof with a written confirmation to go to print, via email, fax or post.

Final proofs must be signed off by the customer in writing, and the sign off email received by Global Visual Ltd. before 6pm, on the day that the proof was sent, in order to receive the prints for the agreed deadline.

ON HOLD

If we have not been notified after 14 days a 5% charge of the total value of the original order will be made plus a £10.00 administration fee.

We reserve the right to throw away your job after 28 days of ordering. Please note you will still be liable to pay the full charge of the total value unless the job is cancelled within the 28 days to which the cancellation charges will apply.

FORCE MAJEURE

We will not be held responsible for failure or delay in the carrying out of our obligations under the contract arising from any cause outside our reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances we shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to you.

MISCELLANEOUS

The contract between ourselves the Company and the Customer shall be governed by and construed in accordance with English Law.

COMPLAINTS

Complaints must be made in writing within 48hours of receiving your goods. The complaint will be assessed and if Global Visual Ltd. deems it necessary, a reprint may be offered. Any complaints made after 48 hours are automatically void of any offer to reprint and will not be assessed.
